RentGuru Master User Agreement

1. Terms and Conditions of Use

This section governs your access to the RentGuru FlutterFlow App and Website.

  • Platform Role: RentGuru is a digital infrastructure provider and a licensed Property Practitioner registered with the PPRA.
  • Eligibility: You must be at least 18 years old and legally capable of entering into a binding contract to use this service.
  • FICA Verification: You acknowledge that you cannot interact with other users or conclude a lease until you have successfully completed the FICA verification process, which includes providing a valid ID and proof of residence.
  • Limitation of Liability: RentGuru is a facilitator and not a party to any lease agreement. We are not liable for "Breach of Lease," property damages, late rent, or illegal evictions. Our liability is limited to software functionality, excluding instances of Gross Negligence.
  • Termination: We reserve the right to terminate access immediately if a user provides false information or violates the Property Practitioners Act.

2. Privacy Policy (POPIA)

This section explains how we handle your personal data in compliance with the Protection of Personal Information Act.

  • Information Collected: We collect your full name, ID number, contact details, and proof of residence to fulfill our statutory duties under FICA and the Property Practitioners Act.
  • Purpose of Processing: Data is processed for identity verification, fraud prevention, and to facilitate the management of tenancies between verified parties.
  • Data Sharing: By using RentGuru, you consent to your relevant contact and identity information being shared with the counterparty (Landlord or Tenant) assigned to your specific lease for management purposes.
  • Security: We are legally obligated to provide adequate protection for the personal information we hold.
  • Data Retention: In accordance with FICA, all verification documents and transaction records will be stored securely for at least 5 years after the relationship ends.

3. Limited Facilitation Mandate (Landlords Only)

This section constitutes a formal mandate between the Landlord and RentGuru as required by the Property Practitioners Act.

  • Nature of Mandate: The Landlord grants RentGuru a non-exclusive, limited mandate for the sole purpose of digital facilitation and transaction tracking.
  • Mandatory Disclosure: As per Section 67 of the Property Practitioners Act, the Landlord must provide a completed and signed Mandatory Disclosure Form regarding property defects before this mandate is accepted.
  • Services NOT Provided: This mandate strictly excludes physical property inspections, maintenance management, debt collection, and formal dispute mediation.
  • Regulatory Reporting: As an Accountable Institution, RentGuru will report any suspicious financial activity to the Financial Intelligence Centre (FIC).
